Message:   "Back in January of this year, I sent correspondence to (Senator Larry) Mumper and (Representative Jeff) Wagner, suggesting they change the penalties with involuntary manslaughter, specifically looking at incidents similar to the Kleinmark case, a reckless omission," explained Egbert. He requested to change such a crime from a third-degree felony to a first, increasing the penalty to three to 10 years.

The letter also requested a change for crimes in which a child is killed at the hands of an adult, such as shaken baby syndrome. Michelle Hofacker's 13-month-old son, Coty Murray, was killed in 1992 as the result of violent shaking by her then-boyfriend Brad Baeder.

Already a first-degree felony, Egbert suggested increasing the penalty for such crimes to the same as a child rape -- life imprisonment with parole after 10 years.

"If we're interested in protecting children under the law and we give such a punishment for rape, a horrible, horrible thing, but the child survives .. why not reconsider when the child is actually killed in a reckless conduct?" questioned Egbert. "Can we protect children a little bit more and have more serious penalties when children die when crimes are committed?"

Rachael and Hofacker both wrote a letter describing the tragic events one year ago and hopes to have her children's names in the legislation.

Egbert has received no reply from the lawmakers. With the death of yet another child -- 8-year-old Richelle Dibble was killed when Max Didion crashed his truck into her Melmore home -- Egbert plans to write the legislators again.

Rachael said that despite the fact she has lost two of her children and her life has completely changed, some people in the community have little sympathy.

"I get a lot of people telling me I'm a dirty, dirty person for putting (Gregg) in jail for an accident," Rachael explained. "But the state of Ohio put him there for his gross negligence, not me."

Today, Rachael is just trying to raise her daughters and move on with her life, but she said she'll always feel the loss of Bryn and Drew.

"Appreciate your kids like it's the last time you'll see them," Rachael advised other parents. "I never got to see Bryn and Drew that day and now I never will."

this something that really hurts inside and i only live a block away from where this all happened and sat watching tv and heard all the emts, fire, and police go out that day and time it took place. It's A Day I never forget the rest of my life.
