Recent changes to the ACR Project

The developer for the ACR recently submitted changes to the APA. Listed in those were the following 3 items.
1. Removing the Lake Simond waste treatment plant and connecting to District 23 sewer lines.
2. Removing 36 homes from the East Ridge site.
3. Elimination of the Great Camp lots east of Mc Cormick road and possible donation of the land to the Natural History Museum.

Let's look at the details of these 3 offers:
1. The Lake Simond waste treatment plant was a fall back for the developer when they could not get the APA approval in time for the existing sewer work being done. These means that district 23 will not be constructed to handle the additional flow and will present financial and environmental issues if the developments try to tie in.
2. The removal of the 36 homes on the East Ridge present the most costly area to build, lowest value in resale and probably would have been impossible to build given the slope conditions in that are. There were also issues with being able to get water pumped that far for fire fighting.
3. The great camps east of Mc Cormick road were taken out of the plan over a year ago because the developer can not get access across the Mc Cormick road. Understanding that means the land is useless to the developer and only present a tax liability. Unloading useless land onto the Museum not only reduces the developers tax liabilities but will present a tax write off for the donation.

Last, the developer is attempting to strong arm the APA into stopping the Adjudicatory hearing. The following is a quote directly from the developers attorney:
"The project sponsor offers these items as mitigation to what has been perceived as potential adverse impacts to its application and not application amendments. If the Agency elects to disagree with this interpretation, all three proposals are withdrawn and the issue conference/public hearing will proceed as currently structured."

This demonstrates that the developer is not interested in helping Tupper lake or working with the APA. The bottom line is that the all mighty dollar is the only motivator in this project.

I see this last attempt of the developer as a slap in the face to the APA, Tupper Lake and the residents as he still tries to pull one over on all of us
